1. Agreement to Terms

By requesting or using any of the services offered by Santa Monica Towing, you acknowledge and accept these terms and conditions. The services include but are not limited to towing, roadside assistance, vehicle recovery, and specialized transport services. If you do not agree to these terms, please refrain from using our services.

2. Services Offered

Santa Monica Towing provides a wide range of towing and roadside assistance services. Our offerings include but are not limited to:

Emergency Towing: Immediate towing services for vehicles in distress.
Flatbed Towing: Towing services for vehicles that require flatbed trucks, such as luxury, exotic, and classic cars.
Roadside Assistance: Tire changes, battery jump-starts, fuel delivery, lock-out assistance, and more.
Luxury & Exotic Vehicle Towing: Specialized care and equipment for high-end cars and motorcycles.
Accident Recovery: Recovery and safe transportation of vehicles involved in accidents.
Long-Distance Towing: Towing services for vehicles over long distances.
Vehicle Storage: Temporary storage for vehicles in secure facilities.

3. Requesting Services

To request towing or roadside assistance services, you must contact Santa Monica Towing directly through our customer service line or our online platform. By requesting a service, you agree to provide accurate information, including but not limited to:

The exact location of the vehicle.
A description of the vehicle, including make, model, and condition.
The specific type of service needed (e.g., emergency towing, roadside assistance).

Failure to provide accurate information may result in delays or improper services, for which Santa Monica Towing will not be held responsible.

4. Payment Terms

4.1 Pricing

Prices for towing and roadside assistance services are provided at the time of request. The final price will depend on factors such as the type of service required, the distance of towing, the time of day (e.g., after-hours services may incur additional charges), and the specific nature of the vehicle.

4.2 Payment Methods

Santa Monica Towing accepts various payment methods, including major credit cards, debit cards, and cash payments. Full payment must be made at the time the service is rendered unless prior arrangements are made.

4.3 Non-Payment

Failure to pay for services provided by Santa Monica Towing may result in the withholding of the vehicle until full payment is received. Additionally, Santa Monica Towing reserves the right to pursue legal action or hire a collections agency to recover unpaid balances.

5. Client Responsibilities

5.1 Vehicle Condition

Clients must ensure that their vehicle is in a safe condition for towing. Santa Monica Towing is not responsible for any pre-existing damage to the vehicle, and the client agrees to release Santa Monica Towing from any liability for such damage. It is also the client's responsibility to ensure that the vehicle is accessible and that the keys are provided if necessary.

5.2 Special Instructions

If the vehicle requires any special handling or care (e.g., for luxury or classic cars), it is the responsibility of the client to inform Santa Monica Towing in advance. Failure to provide this information may result in an increased risk of damage or delays in service.

5.3 Ownership of Vehicle

By requesting services, the client confirms that they are the legal owner of the vehicle or have the express permission of the vehicle owner to request towing services. Santa Monica Towing is not responsible for any disputes regarding the ownership of the vehicle.

6. Towing Process

6.1 Standard Towing

For standard towing services, Santa Monica Towing will transport the vehicle to the destination specified by the client, which may include a repair shop, storage facility, or other designated location.

6.2 Specialized Towing

For luxury, exotic, or classic vehicles, Santa Monica Towing will use appropriate equipment, such as flatbed trucks or enclosed trailers, to ensure the safe transport of the vehicle. Specialized vehicles may require additional fees due to the care and equipment required.

6.3 Timing

While we strive for prompt and efficient service, Santa Monica Towing does not guarantee specific delivery times. We will provide you with an estimated arrival time based on your location and the nature of the service. Delays may occur due to weather conditions, traffic, or unforeseen circumstances.

6.4 Vehicle Condition Upon Delivery

Santa Monica Towing will ensure that the vehicle is transported safely and securely. However, we are not responsible for any damage that occurs due to the vehicle’s pre-existing condition, unforeseen circumstances during transport, or acts of nature.

7. Liability and Indemnity

7.1 Liability

Santa Monica Towing will not be liable for any damages that occur during the towing or transport process unless caused by negligence or improper handling by our staff. We are not liable for the following:

Damage to vehicles resulting from improper loading, unloading, or transport.
Damages to vehicles due to their mechanical or structural condition.
Loss or theft of personal items within the vehicle.
Damages that occur after the vehicle has been delivered to the specified location.

7.2 Insurance

Santa Monica Towing maintains comprehensive insurance coverage for all vehicles in our care. In the event of damage or loss, we will work with you and your insurance provider to resolve the issue. However, clients are strongly encouraged to carry their own insurance to cover any potential damages.

7.3 Indemnification

Clients agree to indemnify and hold harmless Santa Monica Towing, its employees, agents, and contractors from any claims, damages, liabilities, or expenses resulting from:

A breach of these terms and conditions.
Damage to property, vehicles, or persons arising from the towing process.
Negligence or misrepresentation by the client.

8. Vehicle Storage

In the event that your vehicle needs to be stored at our facility due to the service required, we offer secure storage options. Storage fees will apply based on the duration of storage and the size of the vehicle. Clients will be informed of any storage fees before the vehicle is stored.

Vehicles left in storage beyond the agreed-upon time will be subject to additional charges. Santa Monica Towing reserves the right to dispose of or sell any vehicle left in storage for an extended period without payment.

9. Cancellations and Refunds

9.1 Cancellations

If you wish to cancel the requested service, you must do so as soon as possible. Cancellation fees may apply depending on the timing of the cancellation. If the service has already been dispatched, you may be liable for the full cost of the service.

9.2 Refunds

Refunds will only be considered if Santa Monica Towing fails to provide the requested services or if there was an error on our part. Refund requests must be made within 7 days of service. Refunds are processed based on the specific circumstances of the service provided.

10. Force Majeure

Santa Monica Towing will not be held liable for any failure or delay in the performance of our services due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, accidents, or any event that would prevent us from fulfilling our obligations.

11. Dispute Resolution

Any disputes arising from the use of our services will be handled according to the laws of the state of California. In the event of a dispute, both parties agree to seek resolution through mediation or arbitration before pursuing legal action.

12. Changes to Terms & Conditions

Santa Monica Towing reserves the right to amend or update these terms and conditions at any time. Any changes will be posted on our website, and the revised terms will be effective immediately upon posting. Clients are encouraged to review these terms periodically to stay informed of any changes.
